Terms of Service

These terms govern your use of Markuply (the "App"), provided by Digital Genesis ("we", "us"). By installing or using Markuply on your Shopify store, you agree to these terms. If you don't agree, please don't install or use the App.

1. The service

Markuply helps merchants convert AI-generated HTML mockups into Shopify-ready pages: detecting placeholder images, dead links, and non-functional forms, and providing tools to map them to real store content, apply branding, and generate clean, publish-ready HTML.

2. Plans and billing

• Free trial: new shops may convert up to 3 pages at no charge, with no time limit.
• Pro plan: a recurring subscription (currently $18.99/month) that unlocks unlimited conversions and additional features, billed and processed entirely through Shopify's Billing API.
• Subscriptions can be cancelled at any time from the app's Plans page or your Shopify admin's app subscription settings. Cancellation takes effect per Shopify's standard billing cycle handling; we do not separately store or process payment information.
• We may change plan pricing or features going forward; changes will not retroactively alter an active billing cycle you've already been charged for.

3. Your content

You retain all rights to the HTML you paste into Markuply and the pages you generate with it. We claim no ownership over your content. You are responsible for ensuring you have the right to use any mockup HTML, images, or text you provide to the App, including content generated by third-party AI tools.

4. AI-generated features

Certain Pro features (alt text generation, asset labeling, and — where enabled — the AI Touch-up chat) use a third-party AI service to produce suggestions. AI output can occasionally be inaccurate or require adjustment. You're responsible for reviewing generated content — image alt text, labels, or edits — before publishing it to your live store.

5. Acceptable use

You agree not to:

• Use the App to upload or generate content that is unlawful, infringing, or that you don't have the right to use.
• Attempt to circumvent plan limits, rate limits, or security measures built into the App.
• Reverse-engineer, resell, or use the App to build a directly competing product.
• Use the App in a way that could disrupt or overburden its infrastructure or Shopify's platform.

6. Disclaimer of warranties

The App is provided "as is" and "as available." We do not guarantee that detection, mapping, branding, or generated output will be error-free or fit for every use case. You should always preview generated pages before publishing them to your live store.

7. Limitation of liability

To the maximum extent permitted by law, Digital Genesis will not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including lost sales or content published in error. Our total liability for any claim relating to the App is limited to the amount you paid us in the 3 months preceding the claim.

8. Termination

You may stop using Markuply at any time by uninstalling it from your Shopify admin. We may suspend or terminate access to the App for violations of these terms. Upon uninstall, your data is deleted per our Privacy Policy.

9. Changes to these terms

We may update these terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated terms.
